NEW YORK (CNN) - Pfizer Inc. has lost nearly a dozen patent-aid programs in its second quarter and the company's sales for the quarter ended Dec. 31.
The company announced the loss at the end of last year, as the U. S. Food and Drug Administration (FDA) and its other pharmaceutical and non-prescription drugs agency, the agency said Friday that the FDA had not approved its program for the last 12 months. It said the company's marketing of its Celebrex, which treats pain and inflammation, as an over-the-counter drug was approved by the agency in August. The FDA said the drug was a "patent-aid" that is "available" over the counter and "not a prescription-only medication."
The FDA said that Pfizer said it was reviewing the new drugs program.
"We will take additional steps to ensure that this program is approved and the data supporting this decision is reviewed by the FDA," the company said in a statement. "This decision will not be based on a determination by the FDA that the drug is not appropriate."
Pfizer said it would not promote its Celebrex, which is made by Merck & Co. Inc., the maker of prescription drugs for ulcers and gastrointestinal disorders. It also said that it would not promote its generic drug, or Celebrex, which treats arthritis pain.
Pfizer is still seeking approval to sell its Celebrex as an over-the-counter drug. The agency said that it will continue to review the Celebrex and its sales data will be updated with results.
As of Dec. 31, the Celebrex drugmaker said it was reviewing its Celebrex sales data.
The company has filed an abbreviated new drug application for Celebrex in October but said it had not yet received final approval for the drug.
The FDA approved its Celebrex in November in the same manner that Pfizer had approved its generic celecoxib, or Celebrex, in 2006 and 2006, according to a statement from Pfizer. The company's other prescriptions for Celebrex are not yet approved, the statement said. It also said that the drug was expected to undergo the approval process as part of the drug's first phase II clinical trial.
Celebrex, an over-the-counter anti-inflammatory medicine, is used to treat pain and inflammation, as well as rheumatoid arthritis, arthritis of the hip, wrist, and spine, which affects millions of people worldwide. However, the drug is not approved to treat any other conditions, the FDA said.
The FDA said the Celebrex is only for people who are also taking the pain medication or for those who take certain other medications.
Drugmakers have also filed applications with the FDA to reduce their costs by 10% or more for those patients who take the pain medication, or for those who are also taking certain medications.
Celebrex is not the first pharmaceutical to lose patent protection in the United States. In May, a generic drug maker, Merck & Co., lost an exclusive marketing rights for a new drug, in a patent settlement.
The drugmaker has also filed a petition for the FDA to approve the company's Celebrex, according to a statement from Pfizer. The FDA said Friday that the company had not yet received final approval for the drug.
Pfizer said it is reviewing the Celebrex's data. It has also submitted its own data for the company to support the FDA's decision.
